Melonset Terms of Service

Melonset is operated by Blockpulsar, Inc. ("Blockpulsar," "we," "us," or "our"), a U.S.-based company. By using Melonset (the mobile app, website, and related services), you agree to these Terms of Service ("Terms"). How we handle your personal data is described in our Privacy Policy.

1. About Melonset

Melonset is an AI-powered shopping list planner that helps you organize grocery items, meal-related lists, and planning suggestions.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Melonset. If you are under 18, you represent that you have permission from a parent or legal guardian. You may use Melonset only if you can form a binding contract and are not barred from doing so under applicable law.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly at support@melonset.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. User Content and License

You retain ownership of content you submit (such as list items, notes, and prompts). You grant Blockpulsar a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and transmit your content solely to operate, provide, improve, and secure Melonset, including processing through AI features and sharing with collaborators you authorize.

You represent that you have the rights to submit your content and that it does not violate law or third-party rights.

5. Shared Lists

When you share a list, you control (within product features) who can access it. You are responsible for invitations you send and for reviewing shared content. We are not responsible for actions taken by collaborators or for harm arising from information others add to a shared list.

6. AI (LLM) Disclaimer

Melonset uses artificial intelligence, using AI services on Google Cloud, to generate shopping and planning suggestions. Your prompts, list content, images, and voice input are not used to train or fine-tune LLM models, as described in our Privacy Policy. Before you use AI features, the app explains what data may be sent and asks for your permission. While we aim to provide useful results:

  • AI output may be incomplete, outdated, or incorrect.
  • Suggestions are for convenience and informational purposes only.
  • You are responsible for reviewing lists, quantities, prices, and substitutions before purchase.
  • We do not guarantee outcomes such as cost savings, product availability, or nutritional suitability.

7. Food, Health, and Allergy Notice

Melonset is not a medical, dietary, or professional nutrition service. Any meal, ingredient, or product suggestions:

  • Are not medical advice.
  • Are not a substitute for guidance from licensed professionals.
  • May not account for allergies, intolerances, or specific health conditions.

Always verify ingredient labels and consult a qualified professional when needed.

8. Acceptable Use

You agree not to misuse Melonset, including by:

  • Attempting unauthorized access to systems or data.
  • Uploading malicious, unlawful, or abusive content.
  • Using the service in ways that disrupt availability, performance, or security.
  • Impersonating others or misrepresenting your affiliation.
  • Scraping, reverse engineering, or circumventing technical limits except as permitted by law.

We may suspend or terminate access for violations of these Terms.

9. Subscriptions and In-App Purchases

If Melonset offers paid subscriptions or in-app purchases through the Apple App Store or other platforms:

  • Payment is processed by the platform provider (for example, Apple), not directly by Blockpulsar.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
  • You manage and cancel subscriptions in your Apple ID (or platform) account settings.
  • Refunds are handled according to the platform's policies; we do not provide refunds except where required by law.
  • We may change subscription features or pricing with notice where required by the platform or applicable law.

Free trials or promotional offers, if any, will be described in the app at the time of offer.

10. Service Changes and Availability

We may modify, suspend, or discontinue Melonset or any feature at any time. We will use reasonable efforts to provide notice of material changes that adversely affect core functionality. We do not guarantee uninterrupted or error-free operation.

11. Termination

You may stop using Melonset at any time and may delete your account as described in the Privacy Policy. We may suspend or terminate your access if you violate these Terms or if necessary to protect the service, users, or third parties. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

12. Disclaimer of Warranties

To the maximum extent permitted by law, Melonset is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law:

  • Blockpulsar and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
  • Our total liability for any claim arising from or relating to Melonset will not exceed the greater of (a) the amount you paid us for Melonset in the 12 months before the claim or (b) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

We are not responsible for loss or damage resulting from reliance on AI-generated output, shared list content, or third-party services.

14. Indemnification

You agree to indemnify and hold harmless Blockpulsar and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of Melonset, your content, your sharing of lists, or your violation of these Terms or applicable law.

15. Apple App Store Terms

If you downloaded Melonset from the Apple App Store, you acknowledge that:

  • These Terms are between you and Blockpulsar, not Apple.
  • Apple is not responsible for Melonset or its content.
  • Apple has no obligation to provide maintenance or support for Melonset.
  • Apple is not responsible for addressing claims relating to Melonset, including product liability, legal compliance, or consumer protection claims.
  • In the event of failure of Melonset to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.

Your use of Melonset must comply with the Apple Media Services Terms and Conditions and applicable App Store rules.

16. Copyright and Intellectual Property

Melonset, its branding, and underlying technology are owned by Blockpulsar or its licensors and are protected by intellectual property laws. Except for the limited rights granted in these Terms, no rights are transferred to you.

We respect intellectual property rights. If you believe your copyrighted work has been infringed, contact support@melonset.com with the subject Copyright Infringement and include:

  • Identification of the copyrighted work.
  • Identification of the allegedly infringing material.
  • Your contact information.
  • A good-faith statement that the use is unauthorized.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Submitting false claims may result in legal liability.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence apply.

Except where prohibited by law, you agree that exclusive jurisdiction and venue for disputes arising from these Terms or Melonset will be in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Nothing in these Terms limits your right to bring claims in mandatory consumer forums where required by applicable law.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice in the app, on our website, or by email where appropriate. Continued use of Melonset after the effective date of updated Terms means you accept them, except where your consent is required by law.
